Please read the following terms and conditions carefully as they apply to the use of this website and all products/travel services sold by ubookdirect Pty Ltd (referred to as “company”, “us”, “we”, “our”).

Any references to “supplier”, “travel provider”, “booking facilitator” shall mean a supplier of travel related products or reservation services. Any references to “you” “your” means a user of this website

We strongly advise you do not make a booking unless you understand and agree with all the conditions contained within and these conditions apply to all bookings you make with our consultants (either over phone or by email) or online through our websites.

Bookings and payment made to ubookdirect confirms acceptance of these Terms and Conditions and any Provider Terms and Conditions

You agree that it is your sole responsibility to inform any traveling companion(s), guests, or the users of any product or service you purchased of the contents of these Terms and Conditions and all applicable Provider Terms and Conditions

ubookdirect takes every care to provide you with the most up to date and correct information in relation to your travel and accommodation booking and by continuing with any booking you accept that it is your responsibility to be familiar with various travel conditions relating to individual travel products, passports/visa requirements, immigration issues, health and customs requirements.

We will not change any of our terms and conditions which apply to your booking after it has been made by us unless these changes are agreed with you.

For future bookings, our terms may change and we recommend you read them carefully and agree to them each time during the booking process.

Please note bookings made by telephone may incur an additional booking fee which will be advised at time of booking.



All prices are in Australian Dollars ($AU) and based on twin share unless otherwise stated.

Prices are subject to availability and can be withdrawn or varied without notice. Please note that prices quoted therefore are subject to change

Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, transport surcharges and taxes.

The price is only guaranteed once paid for in full by you.

The inclusions that are part of the promoted property can change at any time but will be advised online or at the time of our quotation (by our consultant). All inclusions are confirmed at time of booking confirmation. They will exclude any costs incurred on route to and from the destination, meals (unless specified), alcoholic beverages, telephone calls, items of a personal nature, and personal services (not specified as being included in relevant web pages for each supplier’s product). Rates may not include property taxes or bonds which are paid direct to the property or operator.

Additional terms and conditions may be applicable to “specials” or “conditional sales” and if so they will be displayed on any promotional marketing material or on the booking confirmation.

Some bookings of specials are non-refundable, non-exchangeable and cannot be cancelled or amended under ANY circumstances.



You must let us know at the time of making your booking if you have special requests or needs (such as ground floor accommodation, disability access or specific dietary requirements).

We will try to meet any request you have, however, we cannot guarantee that we will be able to accommodate every person’s needs and we take no responsibility for those which we are unable to fulfil.

If we reasonably feel we are unable to satisfactorily accommodate your particular needs, we reserve the right to decline the booking or ask for you to be accompanied by a person who is able to provide full assistance to you throughout your tour.



A variety of fees and surcharges may be payable, including booking or reservation fees, cancellation and amendment fees, credit card merchant fees, or fees for ad-hoc services performed as required. Please ask us for a schedule of our current service fees and charges.

We may charge a booking fee on the travel services booked on your behalf. The amount will be advised at the time of quotation or booking.

Our booking fee is inclusive of GST and charged when your booking reservation is confirmed. The booking fee is non-refundable.



You may be required to make a deposit in respect of booking your reservation.

The amount of the deposit varies according to the requirements of each travel service provider with whom we make your reservation. The amount of the deposit will be advised to you prior to you booking reservation confirmation by your reservation consultant or shown online.

Certain service providers require the full amount at the time of making the reservation. If this is the case your consultant will advise you at the time of the quotation or booking, though in the case of online booking the full amount is required at the time of booking.

All travel deposits paid are non-refundable (subject to your rights under the Australian Consumer Laws) but may be transferable on request depending on the circumstances of each booking.



All monies paid to us, with the exception of the booking fee, are received by us on behalf of the service provider with whom we are contracted and thereafter paid to them subject to our contractual booking agreement with them.

All monies paid by you to us, will be the property of ubookdirect and will be a debt due and payable to the travel service provider and paid by us as per their payment terms under our agreement with them.

You agree and acknowledge that such monies will not be held by us on trust for and on behalf of you and we may hold such monies in any account as we see fit, including with our own and/or other customer monies.

If you make a booking within 35 days prior to the arrival date of your travel service booking you will be required to pay for your service in full at the time of making the booking.

In the case of bookings outside of 35 days from your arrival date we may accept a deposit and you will be required to pay the balance in full before the booking can be confirmed. The payment date/s will be advised at time of quotation or booking by our consultant or displayed on the website for online bookings.

You agree that if the full amount has not been made by the date advised confirmation of the booking will not be provided.  You also agree that it is your responsible to pay the amount by the require time. Reminders are not sent to you for any outstanding amounts.

If we do not receive all payments due (including any surcharge where applicable) in full and on time, we, or the Travel Supplier reserve the right to treat your booking as cancelled by you and cancellation charges may apply.

We shall process your payments either over the telephone, or online if you are making a booking/payment through our website.



By providing your credit card details and accepting our Terms & Conditions, you authorise ubookdirect to take payment on the date/s advised at time of quotation or booking by our consultant or displayed on the website for online bookings. All booking will include any merchant fee surcharges.



Cancelled bookings may also incur additional supplier fees, which can equal up to 100% of the cost of the booking, regardless of whether travel has commenced.

Supplier fees may also apply where a booking is changed and documents are re-issued.

Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee.

Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.

All government fees, surcharges and taxes are subject to change without notice until the final payment is made and documents have been issued.

Any fees charged to ubookdirect by our credit card payment provider arising from a chargeback or a disputed charge on the cardholder’s credit card will be charged to the cardholder. This fee is non-refundable.



By providing personal information to us, you agree to our Privacy Policy (which can be viewed at http://ubookdirect.flywheelstaging.com/privacy-policy) and you give consent to us collecting, using and disclosing of your personal information as detailed in our Privacy Policy.

Where we disclose your personal information to an overseas recipient, you agree that we will not be required to ensure the recipient’s compliance with Australian privacy laws or otherwise accountable for how the recipient handles your personal information.

By providing personal information to us for the purpose of a quotation or booking, you consent to us contacting you by electronic means (e-mail or SMS) or phone with information regarding your query or reservation or forwarding marketing collateral containing news, products or services that we consider may be of interest to you.



Our booking and services comes with a guarantee that:

•    they will be provided with due care and skill;
•    they will be reasonably fit for the specified purpose made available to us
•    they can reasonably be expected to achieve the desired result; and
•    they will be provided within a reasonable time

Without affecting any statutory consumer rights that cannot be lawfully excluded or limited, ubookdirect Pty Ltd gives no warranties and makes no representations regarding the travel service provided by the supplier specifically; the usability, fitness of purpose, class, standard, rating or visual images of the travel related product or service advertised and is not liable for any misleading or false information, misrepresentations, inaccuracies and errors as a result of incorrect information supplied to us by such parties.



We will not be liable for damages of any kind related to your use of or inability to access this site. Access is not guaranteed and is subject to availability of communications links and access rights. As a user of this website, you must assume full responsibility in the use of our site and you agree that access is undertaken at your own risk.

We sell travel services from our service providers and while we take care in selecting the operators for that service, all quotations and reservations are made in accordance with information made available to us by that operator from time to time.  We do not accept liability for any costs incurred due to any change in availability, supplier over-selling, third party providers, delays and arrangement changes due to events beyond our control, inclement weather or other acts of God. In addition we do not take responsibility for the conduct or services provided by the operator or their staff.

We will not be liable for any death, injury, illness, loss of enjoyment, damage, detention, loss due to delays, additional expense, damage or shock associated with any occurrence whilst using the travel service provided irrespective of its cause.

We are not liable to refund any part of the deposit and/or purchase price paid by you if your booking is subsequently changed or cancelled in connection with a Force Majeure event. World weather patterns, civil unrest and terrorism are becoming more erratic and unpredictable and these are risks beyond our control. It is your responsibility to purchase adequate comprehensive travel insurance to protect yourself against these risks.

Any term, condition or warranty express or implied by Statute or otherwise, for the products and/or services is excluded to the full extent omitted by law. However, nothing in this booking contract excludes, restricts or modifies the application of the Competition and Consumer Act 2010 (Commonwealth) as amended, consolidated, supplemented or replaced.

To the full extent permitted by law, ubookdirect liability arising under or in connection with this booking contract is limited to the re-supply of the products and/or services or the payment of the cost of the re-supply of the products and/or services to you.



Your obligations in the use of Website are:

  • you are at least 18 years of age;
  • you possess the legal authority to create a binding legal obligation;
  • you will only use this Website to make legitimate reservations for you or for another person;
  • all information supplied by you on this Website is true, accurate, current and complete

When you make a booking with us, you have entered into a legal obligations and your right to monies charges or refunds to your credit card or paid in any other way agreed by us, are limited by our terms and policies and by the conditions of our travel provider.

We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer, at any time and for any reason.

You agree to conduct yourself in a proper manner so as to not to cause disturbance or offence to other travellers and you agree to take responsibility for any damage you cause to our or any third party’s property.

We will not be responsible to you for any loss or damage sustained by you arising from or in relation to your contravention of any law of any place while on the tour. You indemnify us for all third party actions taken against us for loss or damage caused by you or arising from your participation on the tour.

On arrival at travel service location or property you may be required to supply a credit card for bond security purposes. If you do not have a credit card or one is not available, you may be required to pay a cash bond.

ubookdirect have several membership programs and you will be issued with a user name and password to participate in these programs and access details on the respective websites which you must ensure the user name and password is kept in a secure place and not available to the general public.

You warrant to ubookdirect that you are the holder of the password used to access this site or have the authority of the password holder to use this site, and enter into a contract with ubookdirect and various suppliers.

We act as an agent for and sell various travel related products as an agent on behalf of numerous accommodation and other travel service providers as well as travel wholesalers.

Our obligation to you is to (and you expressly authorise us to) make travel bookings as your agent on your behalf and to arrange relevant contracts between you and travel service providers.

We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties.

All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers.

We can provide you with copies of the relevant service provider terms and conditions on request.

Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us.

Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.



If any dispute arises between you and us, our contract with you is governed by the law of Queensland, Australia. By booking with us you submit to the exclusive jurisdiction of the courts in Queensland, Australia and waive any right that you may have to object to an action being brought in those courts.



The Australian Government through the Department of Foreign Affairs and Trade has an information website on travel advice for various destinations around the world. We recommend that you refer to www.dfat.gov.au/ or on (02) 6261 3305. This DFAT service will keep you updated on any new developments and offer you the most up to date advice.
